FLORIDA CIRCUIT COURT FAILS TO GRANT MOTION TO PREVENT MEDICAL
JUSTICE FROM COMMUNICATING WITH PLAINTIFFS IN MEDICAL MALPRACTICE
SUIT, SETS IMPORTANT PRECEDENT FOR PHYSICIANS NAMED AS DEFENDANTS
Greensboro, NC, July 20, 2004 Medical Justice Services, Inc., a
company that offers physicians deterrence and defense services to
combat frivolous claims of malpractice, today announced a
favorable decision by the Columbia County Circuit Court in Florida
that enables the company to continue fully defending its client
and sets an important precedent for physicians named as
malpractice defendants. The court indefinitely reserved judgment
of a Motion for Injunctive Relief and/or Restraining Order filed
against the company, its attorney and plan member. Attorney Robert
Jordan, esq., filed the Motion in reaction to a letter he received
from Medical Justice notifying him of countersuit coverage held by
the defendant in the suit, who is a member of Medical Justice. The
company sends countersuit coverage notification letters as
standard practice.
Attorney Jordans Motion sought to curtail communication between
the defendant and his representatives with the plaintiff,
plaintiffs experts, treating physicians and present or future
witnesses in the malpractice lawsuit. Presiding over the hearing
was Honorable E. Vernon Douglas. Plaintiffs counsel did not
challenge the legality of Medical Justice Services, Inc., or its
ability to market itself in the State of Florida.
The failure of this Motion to be granted supports our ability to
exercise free speech in representing and defending our client to
the fullest extent, a right that plaintiffs attorneys have
enjoyed with little restraint for many years, said Jeff Segal,
MD, Chief Executive Officer of Medical Justice. We see this as an
important step toward leveling the playing field for physicians
named as defendants in frivolous medical malpractice lawsuits.
Dr. Segal, a neurosurgeon, founded Medical Justice in 1999. The
companys services are now available in 32 states, Washington,
D.C., and Puerto Rico, many of which the American Medical
Association labels as either Crisis Liability States or states
showing problem signs. The company is endorsed by The Florida
Medical Association, The New York State Neurosurgical Society and
the Coalition and Center for Ethical Medical Testimony.
Run by physicians for physicians, Medical Justice offers the only
proven, proactive physicians countersuit service designed to deter
proponents of frivolous medical malpractice lawsuits and
systematically pursue counterclaims against them. Medical Justice
provides physicians with an affordable, unified offense against
baseless assaults on their reputation and soaring medical
malpractice premiums. Medical Justice is a privately held company
headquartered in Greensboro, North Carolina. The Company can be
